Deed Restrictions:

Seller shall convey to Buyer marketable title in fee simple by transferable and recordable general warranty deed, free and clear of all liens and encumbrances not excepted by this contract, but subject to all valid and recorded leases, restrictions, easements, oil and mineral rights and reservations disclosed by the title search. Seller shall not be responsible for establishing the validity of any recorded documents. Further, the deed may contain the following restrictions if the same are not a matter of record: the property shall be utilized for residential purposes only, and only one single-family permanent dwelling of 1600 square feet or more, with foundation, shall be permitted; no single or double-wide mobile homes with steel undercarriage shall be permitted; trees shall not be cut for commercial purposes; no commercial oil or mineral extraction or commercial animal or pet breeding shall be permitted; accumulation of trash, debris, outside storage, inoperable vehicles, tractor trailers, heavy equipment and other unsightly materials shall be prohibited. Propane tanks must be buried – no above ground tanks of any kind.
